Terms of Service

Last updated: January 2026  ·  Effective date: January 2026

These Terms of Service govern your use of the Far East Advisory website and our professional services. Please read them carefully. By using our website or engaging our services, you agree to these terms. We've written them as clearly as possible — if anything is unclear, please get in touch.

1. Acceptance of Terms

By accessing and using the Far East Advisory website (fareastadvisory.com) or by engaging our services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you are accessing our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

If you do not agree to these terms, please do not use our website or services.

2. Our Services

Far East Advisory provides business advisory and support services for Western businesses operating in or looking to operate in China, Hong Kong, and Taiwan. Our services include but are not limited to:

  • Sourcing and product development support
  • Manufacturing oversight and support
  • Quality control and inspection services
  • Translation and interpretation services
  • Business setup and advisory services
  • Visa and relocation support

The specific services, deliverables, timelines, and fees for any client engagement will be agreed in writing before work commences.

Our services constitute business advisory support. We are not a law firm, accounting firm, or licensed financial advisor. Where legal, accounting, or financial advice is required, we will refer you to or coordinate with appropriately qualified professionals.

3. Free Consultations

We offer a free initial consultation of up to 30 minutes to prospective clients. This consultation is provided without obligation and at our discretion.

Information shared during a free consultation is treated confidentially. The consultation does not constitute the commencement of a formal client engagement and does not create any contractual obligation on either party.

We reserve the right to decline consultation requests at our discretion, including where we believe there may be a conflict of interest or where the enquiry falls outside our areas of expertise.

4. Client Engagements

All formal client engagements commence upon the acceptance of a written proposal or service agreement. No work will begin without a clear written agreement in place covering scope, deliverables, fees, and timeline.

Your responsibilities

To enable us to deliver our services effectively, you agree to:

  • Provide accurate, complete, and timely information relevant to your project
  • Respond to reasonable requests for information, approvals, and decisions within agreed timeframes
  • Inform us promptly of any changes to your requirements or circumstances that may affect the project
  • Ensure that any information or materials you provide do not infringe third party rights

Our responsibilities

We commit to:

  • Delivering services with reasonable skill, care, and diligence
  • Communicating clearly and promptly throughout the engagement
  • Acting at all times in your best interests
  • Maintaining the confidentiality of your information
  • Being honest with you, including when our advice may not be what you want to hear

5. Payment Terms

All fees are agreed in writing before any work commences. Our standard payment terms are:

  • Invoices are payable within 14 days of issue unless otherwise agreed in writing
  • For project-based engagements, a deposit may be required before work begins
  • All fees are quoted exclusive of any applicable taxes unless otherwise stated
  • Late payment may result in work being paused until outstanding amounts are settled

We reserve the right to charge reasonable interest on overdue invoices. If you have a query about an invoice, please contact us promptly and we will work to resolve it quickly.

6. Confidentiality

We treat all client information with complete confidentiality. We will not disclose your confidential information to any third party without your prior written consent, except:

  • Where required by law or regulatory authority
  • To trusted professional advisors or service providers who need the information to help deliver your project, subject to appropriate confidentiality obligations
  • Where the information is already publicly available

If you require a formal Non-Disclosure Agreement before discussions begin, we are happy to enter into one. Please request this before sharing any sensitive information.

7. Intellectual Property

Our content

All content on the Far East Advisory website — including text, graphics, logos, and design — is the property of Far East Advisory and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

Work product

Unless otherwise agreed in writing, reports, documents, and other work product created specifically for you as part of a client engagement become your property upon full payment of all fees related to that engagement.

Your materials

Any materials, specifications, designs, or other content you provide to us remain your property. You grant us a limited licence to use these materials solely for the purpose of delivering your project.

8. Limitation of Liability

While we always aim to deliver excellent service, there are circumstances outside our control in business environments as complex as China and Greater Asia.

To the maximum extent permitted by law:

  • Our total liability to you in connection with any engagement shall not exceed the total fees paid by you for the specific service giving rise to the claim
  • We shall not be liable for indirect, consequential, or incidental losses, loss of profit, loss of business, or loss of anticipated savings
  • We are not liable for the actions, failures, or conduct of third parties, including suppliers, manufacturers, government bodies, or other service providers
  • We are not liable for losses arising from circumstances beyond our reasonable control, including regulatory changes, political events, natural disasters, or supply chain disruptions

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

9. Disclaimers

Our website and its content are provided on an "as is" basis. While we make every effort to ensure accuracy, we make no warranties regarding:

  • The completeness, accuracy, or currency of information on our website
  • The availability or uninterrupted operation of our website
  • That the website is free from viruses or other harmful components

The information on our website is for general guidance only and does not constitute professional legal, financial, or regulatory advice. You should always seek appropriate professional advice for your specific situation.

Business conditions in China and Greater Asia can change rapidly. While we keep our knowledge current, we cannot guarantee that information on our website reflects the most recent regulatory or market developments.

10. Termination

By you

You may terminate a client engagement by providing written notice. You will be responsible for payment of all fees for work completed up to the date of termination, plus any reasonable costs incurred on your behalf that cannot be recovered.

By us

We reserve the right to terminate an engagement with reasonable notice if:

  • You fail to make payment when due
  • You provide materially false or misleading information
  • Continuing the engagement would require us to act in a manner inconsistent with our professional standards or legal obligations
  • A conflict of interest arises that cannot be resolved

Effect of termination

Upon termination, we will provide you with all work completed to date. Confidentiality obligations, intellectual property provisions, and payment obligations for completed work survive termination.

11. Governing Law & Dispute Resolution

These terms are governed by and construed in accordance with applicable law. In the event of any dispute arising from these terms or our services, we encourage you to contact us first to seek an amicable resolution — we take all concerns seriously and will work hard to resolve issues fairly.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing formal legal proceedings.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will update the "Last updated" date at the top of this page when we do so. Significant changes will be notified to active clients directly.

Your continued use of our website or services after any changes constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.
